Attacker’s Mental Illness Does Not Negate Assault Exception for Workers’ Compensation

?An assailant’s mental illness did not alter the finding that his attack on a hotel employee was intentional and personal, the Minnesota Supreme Court held, affirming the findings of the Workers Compensation Court of Appeals (WCCA) that the claim fell within the scope of the state’s assault exception for a covered injury.

In June 2018, while the employee was cleaning a hotel room, he was attacked by an acquaintance with whom he had previously worked at a different employer. The attacker, because of a mental illness, falsely believed that the employee was involved in killing his uncle. The uncle had died from a heart ailment with no evidence of foul play.

The employee was severely injured and filed a claim for workers’ compensation benefits. Minnesota has a no-fault workers’ compensation program and awards benefits for the personal injury or death of an employee arising out of and in the course of employment. However, the compensation judge denied the claim on the basis of the statutory definition of “personal injury.” The definition excludes Injuries caused by an individual who intended to injure the employee because of personal reasons, completely unrelated to employment—called the “assault exception.”

The compensation judge held that the assault exception does not require reasonable or rational thought and stated that “there is no carve-out exception for mental illness.” The compensation judge also reasoned that the threshold determination that the attacker was motivated for purely personal reasons was enough to bar the workers’ compensation claim. The judge also rejected the argument that the employment environment increased the employee’s risk of injury.

The WCCA agreed on appeal, and the employee then appealed the ruling to the state Supreme Court.

The employee argued that an assailant who was declared incompetent to stand trial following an assault cannot be found to have formed the intent necessary under the assault exception.

Looking at the plain meaning of the word, the court determined that a third party’s act is intended when it is deliberate or intentional. Under workers’ compensation law, an act is intended to injure when the third party has the injury of an employee as the object to be gained or achieved. Thus, the court reasoned, the only factor to consider in determining if an assailant’s state of mind takes their action outside the coverage of the state’s workers’ compensation statutes is whether the assailant had the conscious and deliberate intent to inflict injury.

The court affirmed the WCCA’s ruling, saying, “The assault exception does not require a specific level of rationality, but rather the assailant must consciously and deliberately act to injure the employee for personal reasons.”

Florida Will Require Employers to Use E-Verify

?As part of a potentially growing trend, a new law in Florida will require private employers with at least 25 employees to use E-Verify, the digital immigration verification tool, during their onboarding process, starting July 1.

Gov. Ron DeSantis signed SB 1718 into law on May 10. It will increase penalties for noncompliance and for employers that knowingly hire undocumented workers. Notably, if employers use the E-Verify system in good faith, whether use is mandatory or voluntary, the government will presume they have not knowingly hired unauthorized workers.

All employers are required to complete the I-9 form within three days of a new hire’s start date to verify identity and ensure employment authorization in the United States for every employee. E-Verify is an online tool that is operated by the U.S. Department of Homeland Security and allows employers that have completed Form I-9 to electronically verify employment eligibility for their new hires. Employers that use E-Verify may not do so selectively. Rather, they must use the system to verify all newly hires, regardless of whether they are U.S. citizens.

Currently, use of the E-Verify system is mandatory in Florida for public employers and private employers contracting with state and local governments or receiving state incentive dollars. The new law expands that requirement to all private employers with at least 25 employees. Employers that want to enroll in E-Verify can do so by visiting the official website.

  • Compliance presumed: Employers that use the E-Verify system establish a rebuttable presumption that they have not knowingly employed an unauthorized worker. If the E-Verify system is down for three days, and you cannot timely complete the process for a new hire, you can still benefit from the rebuttable presumption by completing Form I-9 and taking a screenshot each day, documenting that the system is unavailable, or retaining any official notice or communication you received about the system being down.
  • Annual certification required: Each employer that is required to use the E-Verify system must certify compliance on its first return when making contributions to or reimbursing the state’s unemployment compensation or reemployment assistance system. An employer that voluntarily uses the E-Verify system may make such a certification on its first return each calendar year in order to document such use.
  • Penalties for noncompliance: Penalties will go into effect on July 1, 2024. Businesses have 30 days to cure noncompliance after receiving notice from the Department of Economic Opportunity (DEO), and the new law requires the DEO to notify a business prior to issuing penalties for violations. If the DEO determines that an employer failed to use the E-Verify system as required three times in any 24-month period, the department must impose a fine of $1,000 per day until the employer provides sufficient proof that the noncompliance is cured. An employer’s first violation results in a one-year probationary period with reporting requirements to put a business on a path to compliance prior to any licenses being revoked.

Benefits for Small Businesses

Businesses with fewer than 25 employees can continue to use the Form I-9 to verify employment eligibility or choose to take the extra step of using E-Verify, which comes with heightened immunity protections. Employers that voluntarily use E-Verify may submit annual certifications for documentation purposes.

Employers that operate in multiple jurisdictions will need to track this potential trend in legal requirements.

Washington to Bar Employers from Relying Marijuana Use in Hiring Decisions

?The state of Washington will prohibit employers from making hiring decisions based on off-duty use of cannabis or positive pre-employment drug test results that find an applicant to have nonpsychoactive cannabis metabolites in their hair, blood, urine or other bodily fluids. The new law will take effect Jan. 1, 2024.

Noting that recreational cannabis was legalized in Washington in 2012 and that it should now be treated like alcohol, the new law is intended to prevent restricting job opportunities based on an applicant’s past use of cannabis.

Cannabis metabolites can stay in the body for long periods of time, and most drug tests will detect nonpsychoactive cannabis metabolites for up to 30 days after use. Past use of marijuana has no correlation to an applicant’s future job performance, given that marijuana is a legal substance.

The law does not prohibit employers from basing initial hiring decisions on scientifically valid drug screening conducted through methods that do not screen for nonpsychoactive cannabis metabolites.

Like a similar California law that also will take effect in 2024, the Washington law contains no explanation of what is meant by “nonpsychoactive cannabis metabolites,” and there are no drug tests that can distinguish between psychoactive metabolites (those that create a high) and nonpsychoactive metabolites. If no such drug tests are developed by Jan. 1, 2024, Washington employers will not be able to test for marijuana on pre-employment drug tests.

The law further states that it does not prohibit employers from maintaining a drug and alcohol-free workplace and does not affect any other rights or obligations of an employer required by federal law or regulation.

Employers still may drug test for marijuana on tests other than pre-employment, such as post-accident and reasonable suspicion. Additionally, employers still may test for other drugs, as well as alcohol.

The law does not apply to applicants seeking:

  • Positions requiring a federal government background investigation or security clearance.
  • Certain law enforcement positions.
  • Certain fire department positions.
  • First responder positions, including 911 dispatchers.
  • Corrections officer positions.
  • Positions in the airline or aerospace industries.
  • Safety-sensitive positions for which impairment while working presents a substantial risk of death. Such safety-sensitive positions must be identified by the employer prior to the person’s application for employment.

The new law does not preempt state or federal laws requiring an applicant to be tested for drugs. This includes testing that is related to the receipt of federal funding or federal licensing-related benefits or as required by a federal contract.

It is permissible to test applicants for cannabis, as along as the test result is not provided to the employer. Washington employers should review their drug and alcohol testing policies to ensure that they will comply with the law as of Jan. 1, 2024.

Jobless Claims on the Rise

The U.S. Department of Labor reported today that initial claims for state unemployment benefits rose by 22,000 to 264,000 in the week ending May 6. This is the highest level for initial claims since Oct. 30, 2021.

The increase was driven by a rise in layoffs in the leisure and hospitality, construction and manufacturing sectors, and is a sign that the labor market is slowing down. Economists are watching closely to see how the labor market responds to the Federal Reserve’s rate hikes. If the labor market weakens significantly, it could lead to a recession.

U.S. employers added 253,000 new jobs in April, beating economists’ expectations, and the unemployment rate ticked down to 3.4 percent, one of the lowest levels on record, according to the latest employment report from the U.S. Bureau of Labor Statistics.
